Man accused in fatal 2013 pedestrian crash returns to court

CHATHAM – The man accused of killing a pedestrian in Chatham during a high-speed chase nearly two years ago returns to Barnstable Superior Court Tuesday for a possible disposition of the case.

Benjamin Shealey’s lawyer rejected a plea this past winter that would have sent him to prison for up to 10 years. It’s unclear what will happen during the 10 a.m. hearing on Tuesday, according to Assistant District Attorney Tara Miltmore.

Prosecutors say Shealey led police on a chase from Harwich into Chatham on July 13th 2013. Police called off the chase but Shealey allegedly kept going and lost control crashing by the Kream ‘N’ Cone on Route 28. A pedestrian, Albert Dekmarva, 62, of Orleans was killed. Shealey’s Range Rover crashed into an SUV in the parking lot critically injuring 3 members of a family in that vehicle including two children.

Shealey faces motor vehicle manslaughter charges. His trial is still set for May 5.
