FALMOUTH – Falmouth Police report that with assistance from the Mashpee Police Department and the Barnstable County Sheriff’s Department, they executed a motor vehicle search warrant in the public parking area of Falmouth Harbor on Clinton Ave. The operator of the vehicle, Russell Pena, has been the subject of a narcotics investigation where he is suspected of distributing Heroin and Cocaine. The search resulted in the arrest of Pena, 38, of Falmouth (top right) and a passenger in the vehicle, Michael Lopes, 48, of Mashpee (lower right). Discovered during the search was marijuana, cocaine and $1,450 in cash.
During the booking procedure at the police station police say Mr. Pena became combative and began to struggle with officers. During this struggle he was able to remove a bag of narcotics believed to be heroin from his pants in the area of his genitals. Pena then tore the bag apart and dispersed the drugs in the air purposely toward and onto the police officers.
Two officers, as well as Mr. Pena, were transported to Falmouth Hospital for treatment for exposure to narcotics.
Falmouth Police reported Friday afternoon that both officers and Pena were treated and released from Falmouth Hospital. Pena was held on $25,000 bail. Lopes was still awaiting arraignment at Falmouth District Court.
Mr. Pena is being charged with the following offenses:
- Attempted Murder (2 counts)
- Possession of a Class B substance
- Trafficking a Class A substance
- Obstruction of Justice
- Assault and Battery by means of a Dangerous Weapon (2 counts)
Mr. Lopes is being charged with the following offenses:
- Conspiracy to Violate the Narcotics Laws
- Being present where heroin is kept
