Charges filed in serious pedestrian accident earlier this month in Hyannis

HYANNIS – Barnstable Police report that on March 17th at approximately 3:40 AM, Barnstable Police officers were called to Sea Street and Summerside Lane in Hyannis for a pedestrian vs. motor vehicle accident. Officers arrived to find the victim, 26-year-old Newman Galati of Hyannis, lying on the pavement with extensive injuries to his hip, leg and torso. The involved vehicle, a 2008 BMW 550I sedan, was also on scene along with the operator identified as 21-year-old Hudson Aguiar of Osterville.

Aguiar stated he and two passengers left a home on Seabrook Road en route to a residence on Oak Neck Rd. Hyannis. Aguiar said he approached the intersection of Sea Street and saw what he thought was a trash bag lying in the road. Aguiar stated he drove over the object and felt his vehicle hit something which he thought was snow or ice. Aguiar said he pulled onto Sea Street in a northerly direction and noticed his vehicle was not operating correctly, as if something may be wedged under the vehicle. He proceeded north for several hundred feet before turning left into Summerside Lane to investigate the problem. At that time, Aguiar said he looked under his vehicle and discovered Galati, with extensive injuries, wedged under the engine compartment. Aguiar got back into his vehicle and backed the car off of Galati, freeing him from the under carriage. Aguiar said he then maneuvered his vehicle around Galati as he lay in the road. Aguiar turned his vehicle around at the end of Summerside Lane, and drove past Galati a second time as he and his passengers left the scene and proceeded to their destination on Oak Neck Road. After spending several minutes on Oak Neck Road, and notifying another friend of the incident, Aguiar stated he and his passengers, along with a friend in a second vehicle, drove past Galati a third time as he lay injured in the roadway, and proceeded back to the residence on Seabrook Road. There, Aguiar said he called a family member in Osterville. Aguiar advised the family member of the accident and the family member responded from Osterville and met Aguiar at the accident scene where Aguiar called 911.

It is estimated that at least 43 minutes passed between the moment Aguiar realized he had struck and severely injured Galati, to the time he made his call to 911 for help.

Aguiar and the passengers in his vehicle all agreed to give interviews at the Barnstable Police Station on the night of the accident. As a result of this investigation, Aguiar has been issued a citation and will be summoned to appear in court to face charges of Leaving the Scene of a Motor Vehicle Accident resulting in Injury, Negligent Operation of a Motor Vehicle, and Defective Equipment. A date for his court appearance has not been set.

The victim, Newman Galati, continues to recover from his injuries in a Boston hospital.
