Man arrested for OUI, resisting arrest in Yarmouth

YARMOUTH – Yarmouth Police report that on Monday at approximately 1:02AM, they received a call for help from the employees of Oliver’s restaurant located at 960 Route 6A in Yarmouthport asking for assistance with an intoxicated man who was trying to leave and drive home.

Yarmouth Police Department Patrol Officers Ryan Golden and Ryan Murphy were dispatched and prior to arrival were advised that employees had tried to stop the subject from driving and offered him a safe ride home but he resisted, became violent, and drove away.

The employees provided a description of the subject and his license plate.

Officer Golden, Murphy, Gordon Gibbons and fellow midnight shift Patrol Officers found the vehicle and the operator a short distance away on South Yarmouth Road.

Yarmouth Police report the driver, identified at Patrick T. Leary, 29, of Dennis, refused to exit his vehicle and was physically and verbally combative. Leary was determined to be intoxicated and placed him under arrest for OUI.

A team of Police Officers, assisted by the use of a Taser, were able to bring him under control.

Leary allegedly spit at and continued to be verbally abusive and swearing at the Police Officers the entire ride to YPD Headquarters.

Leary’s gray Honda Accord was towed and impounded. He was booked at YPD Headquarters on charges operating under the influence of liquor (2nd offense), operating negligently to endanger, disorderly conduct, resisting arrest, and open container of alcohol in a vehicle. Leary was held and transported to the Barnstable District Court Monday morning for arraignment.
