YARMOUTH – Yarmouth Police report that on Friday, March 2, 2018 at approximately 8:26 PM, the Yarmouth Police Department Dispatch Center received a call regarding an apparent motor vehicle crash in the area of Dennis Pond in Yarmouthport.
Yarmouth Police Department Patrol Officers and Yarmouth Fire Department Firefighters were sent to the area and upon arrival found a BMW sport utility vehicle on Summer Street near Dennis Pond.
Patrol Sergeant Gerard Britt arrived first and observed the front of the vehicle with very heavy front end damage.
The driver stated he had hit a nearby tree but police were unable to find a tree in the area with damage.
YPD Patrol Officer Jason Batchelder determined the driver had been drinking and was given a series of Standardized Field Sobriety Tests which were:
Horizontal Gaze Nystagmus
Walk and Turn
One Leg Stand
Counting
The operator failed the tests and was placed under arrest for OUI and transported to Yarmouth Police Department Headquarters.
At YPD Headquarters, it was determined that operator, 27-year-old Bhaumik A. Patel of Yarmouthport had been previously arrested and convicted of OUI and is currently on Probation for OUI.
Mid Cape Collision towed the heavily damaged vehicle from the scene.
Patel was charged with operating under the influence of liquor (2nd offense), and operating negligently to endanger. He was processed at Yarmouth Police Department Headquarters and was due for arraignment in the Barnstable District Court on Monday.
At this morning’s Day Shift Roll Call, Officers were briefed on the unsolved crash. Rick Vermette, the owner of Mid Cape Collision had reported that he believed the damage to the BMW was caused by the vehicle hitting a guard rail system.
Day Shift Patrol Officer Louis Nickinello, Jr. reported that he had observed fresh damage to a guard rail system at Independence Park near Mary Dunn Road in Hyannis over the weekend.
YPD advised the Barnstable Police Department and Barnstable Police Department Patrol Officer Matt Lounsbury went to the scene and found the damaged guard rail system and upon closer examination, found the actual license plate from the BMW on the ground at the crash site.
Barnstable Police will now be filing a charge of Leaving the Scene of a Motor Vehicle Crash against Patel today.
