HYANNIS
– Barnstable Police report that on Friday November 24, 2017 at approximately 4:15 PM, officers responded to the scene of a shooting on Fresh Holes Rd in Hyannis. Responding officers found a male victim suffering from a 9mm gunshot wound. The victim was taken to CCH for treatment. Since that date, Barnstable Detectives have been investigating the shooting. Pursuant to that investigation, Detectives identified Dilon and Denzel Smith (both age 25) as being involved in the incident.

Coincidentally, the Smith brothers have been under investigation by Barnstable and Yarmouth Detectives for the past two months for allegedly distributing large quantities of suspected Fentanyl in the mid-Cape area. Wednesday November 29th, BPD and YPD Detectives executed two search warrants in Hyannis related to the shooting and the drug investigation. Detectives searched 89 Lewis Bay Road, apt 209, and located the suspected clothing believed to be worn by the shooter, Dilon Smith.

Detectives also searched a suspected drug “stash” house used by the brothers located in the basement apartment of 177 Megan Road in Hyannis. Detectives believe that Denzel Smith left the scene of the shooting and traveled directly to this residence. At approximately 2 PM, Detectives located Denzel and Dilon Smith at the residence. A subsequent search yielded approximately 100 grams of suspected Fentanyl, a 9mm pistol and a .22 caliber revolver (both loaded), 2 drug presses, packaging materials, and digital scales. Ballistic tests will confirm whether the 9mm recovered is the weapon used in the Fresh Holes Road shooting.

Dilon Smith was arrested and charged with the following offenses: possession with intent to distribute a Class B substance (Fentanyl), conspiracy to violate the controlled substance act, unlawful possession of a firearm (2 counts), possession of ammunition without an FID card (2 counts), and committing a felony while armed. Pursuant to the shooting, he was charged with assault with intent to murder, assualt and battery with a dangerous weapon (firearm), committing a felony while armed, and discharging a firearm within 500 feet of a building.

Denzel Smith was arrested and charged with the following offenses: possession with intent to distribute a Class B substance (Fentanyl)(subsequent offense), conspiracy to violate the controlled substance act, umlawful possession of a firearm (2 counts), possession of ammunition without an FID card (2 counts), and committing a felony while armed. Denzel was also charged with being an armed career criminal with 4 prior violent/felony drug convictions. Pursuant to the shooting, Denzel was charged with being an accessory after the fact/felony.
