Updated: Yarmouth and State Police charge man with assault; weapons violations

YARMOUTH – Yarmouth Police Department Patrol Officers and Massachusetts State Troopers responded to a call early Friday morning behind the Massachusetts State Police Barracks for a report from a citizen stating that a male had just pulled a gun on her and her friends in his front yard.

The reporting party and two friends were located nearby in the parking lot of the Yarmouth Town Hall. The three were visibly shaken up, pacing back and forth, speaking very rapidly, and appeared to be in shock.

The parties stated that they had just gone to their friends’ house in order to help their friend get away from her boyfriend and out of the house. The parties stated that once they had arrived at the residence the woman’s boyfriend had become extremely agitated by their presence.

They reported that the boyfriend had come outside upon their arrival and began swearing at them. The boyfriend—now referred to a suspect—then walked over to a trailer located in the front of the house.

All three individuals stated that the suspect had entered the trailer, picked up a shotgun located in the trailer, and “cocked” the shotgun. They then stated that the suspect had walked over to the vehicle, and pointed the shotgun at the women.

At this time Police Officers were informed that the woman was still in the residence with the suspect.

Yarmouth Police Department Patrol Officers and Massachusetts State Troopers immediately established a secure perimeter around the residence.

Yarmouth Police Department Patrol Sergeant John K. Fallon—who is a specially trained Crisis Negotiator—then contacted the suspect via telephone. The suspect came out of the residence with his hands up, obeyed Police Officer’s commands, and was handcuffed and placed under arrest.

The residence and scene was then fully cleared and secured.

The suspect was advised of the charges and read his Miranda rights. The suspect stated that he had five firearms. He identified these firearms as: a 12 gauge shotgun, .40 caliber handgun, 9mm handgun, .380 caliber handgun, and a .22 handgun.

Subsequent to the arrest a consent search of the residence was completed and the following was found:

.22 Caliber Rifle w/ gun case and scope- located on kitchen counter
Shotgun loaded w/ 3 rounds- bedroom closet
Subsequent to the arrest a consent search of a Mitsubishi motor vehicle was completed and the following was found:
.380 Caliber handgun w/ loaded magazine/holster- between center console and passenger seat

Subsequent to the arrest a consent search of a Chevrolet motor vehicle as completed and the following was found:

.380 mag w/ 6 rounds
.9mm magazine w/ 10 rounds- center console
Two 40 caliber magazines w/ 10 rounds each- center console
40 caliber handgun w 10 round magazine/holster- center console
Plastic gun box w/ 2 .22 rifle magazines and multiple .22 caliber rounds- back seat
Plastic ammo box w/ 40 caliber rounds and multiple 12 gauge shotgun shells- back seat
9mm handgun

The suspect—who cannot be identified by police at this time due to the Massachusetts Domestic Violence Laws—has had his License To Carry Firearms immediately suspended by the Chief of Police and was transported to the Barnstable District Court this morning for arraignment on the following charges:

Five Counts of Assault with a Dangerous Weapon- Shotgun
Five Counts of Improper Storage of a Firearm

Once arraigned, the suspects’ identity became public record. The suspect is Branden Harris, 24, of South Yarmouth.
