police carMARSTONS MILLS- Barnstable Police arrested 26-year-old Daniel Kelley yesterday morning, after they say he stumbled into a neighbor’s home on Wakeby Road and fell asleep on their couch.

The homeowner found Kelley around 6:30 a.m. and notified police, who then dispatched two patrol units to the scene.

Once inside the home, Officer Harmon of the Barnstable Police Department attempted to wake Kelley from his sleep, but Kelley continued to roll over and ignore the officer.

Eventually Kelley awoke, asking the officer if it was “illegal to sleep.”

After Officer Harmon asked Kelley where he was, he answered “in Maine?”

Kelley was arrested and charged with Breaking and Entering and was in protective custody for being intoxicated.

The homeowner told police he didn’t know how the intruder got into the home, as all the doors were locked.

Police say Kelley was drunk when he made his way into the home Wakeby Road through the rear bulkhead, and then made his way through the basement to the upstairs and onto the couch.

Kelley lives only blocks away from the home he broke into.

Barnstable Police say that Kelley will be arraigned soon, but no date has been set.
