Bourne Murder Suspect Arraigned in Superior Court

BARNSTABLE – In a strong, clear voice, Adrian T. Loya, the man accused of murder in the shooting that took place last February in Bourne, answered “not guilty” twelve times as his indictments were read in Barnstable Superior Court yesterday.

Loya, who turned 31 years old on the day of the crime and lived in Chesapeake, Virginia, was arraigned on 30 indictments in 12 charges, stemming from the death of Lisa Trubnikova and the shooting of her spouse, Anna Trubnikova, in their condominium in Monument Beach on February 5, 2015.

Loya and the two victims were members of the US Coast Guard.

During the police response to the shooting, Bourne Police Officer Jared MacDonald was shot and wounded.

Loya is charged with murder, three counts of armed assault to murder; three counts of aggravated assault and battery; two counts of armed home invasion; two counts of armed assault in a dwelling; three counts of use of a firearm in the commission of a felony; two counts of armed kidnapping with serious bodily injury; burglary and assault on an occupant; arson of a motor vehicle; possession of a hoax device; assault and battery on a police officer; and 10 counts of possession of a large capacity feeding device.

A grand jury indicted Loya on the charges on July 2. He is being held at Bridgewater State Hospital where he is undergoing evaluations.

Discussion between the attorneys during yesterday’s arraignment revolved around a Bridgewater State Hospital report that was ordered sealed by Judge Gary Nickerson.

Nickerson said he was interested in the report because of the issues of competency and criminal responsibility.

After reading the report, Nickerson said, “The court has a serious concern as to whether this gentleman is competent.”

Loya’s attorney, Drew Segadelli, said the report is not to be released at this time to First Assistant District Attorney Brian Glenny, who is prosecuting the case for the Cape and Islands District Attorney’s office.

Judge Nickerson said Segadelli should prepare a redacted version of the report for Glenny before the next hearing if Segadelli plans to contest Loya’s competency or criminal responsibility.

Loya will continue to be held without bail at Bridgewater State Hospital. Judge Nickerson said he will order a further competency evaluation.

The next pretrial date to hear the results of that competency evaluation is scheduled for Monday, August 3.
