Falmouth Selectmen Discuss, Grant Bylaw Variance

FALMOUTH – For a number of weeks, Falmouth selectmen have discussed guidelines for granting a variance to a bylaw regarding wastewater and sewer hookup.

The town’s flow neutral bylaw restricts the amount of wastewater discharge from any new non-residential development up to 110 gallons a day per every 10,000 square feet.

It also helps protect the town’s wastewater treatment facility; manage present and future wastewater flows; meet present and future water quality standards; and support community planning objectives.

“The board of health must certify to you (selectmen) that an adequate septic system can be sited on the parcel,” said Town Counsel Frank Duffy.

Any development that exceeds that amount needs a variance from the town.

A proposed hotel development was the first project to receive a variance from the town, meaning if it moves forward would be allowed to exceed the bylaw’s daily discharge restrictions.

“Because the proposal that’s before you exceeds that, the connection to the sewer requires a variance from you, acting as a variance granting authority,” said Duffy about the selectmens’ responsibility.

The project is in the very early stages and still needs to be reviewed by the Cape Cod Commission.
