Judge Takes Fire District Prop 2 1/2 Case Under Advisement

BOSTON – The latest development in the Hyannis fire station saga took place Wednesday.

Hyannis resident and fire station opponent John Julius and lawyers for the fire district appeared before a judge in U.S. District Court in Boston.

Julius and his wife have filed suit against the district, arguing that their pursuit of a new fire station should not be exempt from Proposition 2 1/2.

“The Hyannis Fire District continues to claim its exemption from the Proposition 2 1/2 law because they say the word ‘district’ does not appear in the context of the law,” Julius said. “The law should apply regardless whether the word district is in there or not.”

US District Court Judge Denise Casper took the argument under advisement.

Lawyers for the district have asked the case to be dismissed.
