Zinov to Remain Behind Bars

BOSTON – 29 year old former Centerville resident  Ilya Zinov will spend the next several years in prison on a 2014 conviction for, among other charges, attempted murder, after a 2011 shooting that left John Lopes shot in the back, neck and arms.

Zinov’s appeal of his conviction to the State’s Appellate Court  was rejected Thursday and a lower court ruling that denied Zinov a new trial was upheld.

The shooting was the result of Zinov’s interaction with Lopes during an argument between Lopes and his girlfriend at Ying’s Sushi Bar and Lounge in Hyannis.

After the encounter, Lopes was changing a tire in the parking lot of the restaurant when the shooting took place. According to Cape and Islands District Attorney Michael O’Keef’s office, Lopes has lasting injuries from the shooting.

Zinov was convicted of armed attempt to murder, aggravated assault and battery with a dangerous weapon, carrying a firearm without a license, possession of a firearm in the commission of a felony and firearm violation with two prior drug convictions. He was sentenced to 12-15 years in prison

Zinov based his appeal on the contention that the state’s closing argument was improper and that the grand jury that indicted him should have been told about a deal the victim made with prosecutors. Both of those arguments fell flat with the Appeals Court.
