Court Records Impounded in Bourne Triple Shooting

BOURNE – State and local police continue to investigate the triple shooting Thursday in Bourne.

Cape and Islands District Attorney Michael O’Keefe has not released any additional information on the case since Friday when he released the names of the victims.

The shooting in which one person was killed and two were seriously injured occurred at a condominium unit on Roundhouse Road in the Monument Beach section of Bourne. Police responded at about 2:15 a.m. and say they were subsequently ambushed by the suspect. A police officer was shot in the back during the melee.

The court records on the case were impounded at the request of J. Drew Segadelli, the attorney representing the suspect, Adrian Loya of Chesapeake, Virginia.

Segadelli said he impounded the court records for several reasons.

He said releasing the records to the pubic—and more specifically the media—could prejudice the public and future jury members against his client, “convicting the fellow before I have even investigated the case.”

He also said he requested the impounding in deference to the families of the victims, who had not yet been notified. “There are a lot of components to that,” he said of the request to impound the file.

He added that while it was his motion to impound the file, “it was agreed upon by everyone,” meaning the prosecutors and the judge.

Coast Guard Commander Linda Fagan of the First Coast Guard District said the Coast Guard is assisting law enforcement officials in the investigation, which involved three Coast Guard members, Loya, the suspect, as well as two of the shooting victims, including one who was killed Coast Guard Petty Officer 2nd Class Lisa Trubnikova, 31, of Coast Guard Base Cape Cod.

Her spouse, Coast Guard Petty Officer 3rd Class Anna Trubnikova, 30, of Coast Guard Sector Southeastern New England was injured in the shooting. She is in stable condition at Rhode Island Hospital in Providence.

Loya, 31, who holds the rank of Petty Officer 2nd Class at Coast Guard Base Portsmouth, Virginia, was arraigned Thursday in Falmouth District Court on numerous charges stemming from the shooting, including murder.

Besides murder, the charges were two counts of armed assault with intent to murder, two counts of home invasion, burglary armed assault on occupants, arson of a motor vehicle and assault and battery of a police officer. O’Keefe said more charges may be forthcoming as police investigate.

Loya pled not guilty to the charges and is being held without bail at the Barnstable County Correctional Facility. His next court appearance is a pre-trial hearing on March 23.

Fagan released the following statement after the shooting, “In the wake of this tragedy, I invite everyone to join me to in offering our thoughts and prayers for the families, friends and loved ones of those impacted. In committing our support to them, our focus turns to remembering the life and service of Petty Officer Lisa Trubnikova and aiding the recovery of Petty Officer Anna Trubnikova.”

Fagan also praised the actions of the Bourne Police Department, who, she said, “responded quickly and courageously as events unfolded . . .Their response saved the life of Petty Officer Anna Trubnikova and removed the threat to the community.”

Fagan also offered thanks to Bourne Police Officer Jared MacDonald, who was shot in the back during the attack. MacDonald is a Coast Guard veteran and two of his children attend Massachusetts Maritime Academy.

“We extend our heartfelt thanks to those in the community and the Coast Guard family who stand alongside us as we mourn the tragic loss of Petty Officer Lisa Trubnikova and wish the speedy recovery of Petty Officer 3rd Class Anna Trubnikova and Officer Jared MacDonald,” she stated.
