Court Rules in Favor of Chatham in Skydiving Lawsuit

CHATHAM–The Barnstable Superior Court ruled in favor of the Town of Chatham last week in regards to a 2015 lawsuit filed by Citizens for A Safe Chatham Airport (CFSCA).

The suit, filed in 2015, asserted that the contracting of skydiving concessions by the town at the Chatham Municipal Airport qualifies as a nuisance under the Massachusetts Tort Claims Act. 

The Superior Court ruled that federal law–specifically from the FAA–preempts state law application in the matter.

CFSCA may choose to appeal this decision to the Appeals Court within 30 days.
