Massachusetts Sues Retailer of Vaping Products

BOSTON (AP) — The Massachusetts attorney general has sued a national retailer of e-cigarette and vaping products she alleges violated state law by targeting minors for sales of its merchandise.

In the complaint filed Wednesday, Attorney General Maura Healey says Eonsmoke LLC failed to verify online buyers’ ages and failed to ensure shipments were received by a person 21 or older, as required by state law.

The suit says Eonsmoke “directly targeted underage consumers” and sells products in sweet and fruit flavors.

The complaint seeks a halt to the company’s “unfair and deceptive practices” and unspecified civil penalties.

Michael Tolmach, CEO of Clifton, New Jersey-based Eonsmoke, said in an email to The Boston Globe that he had not reviewed the complaint, but shares Healey’s concerns about youth vaping and is cooperating with her office.
